At its October 8, 2026 meeting, Taiwan's Executive Yuan passed the Ministry of Economic Affairs' draft amendment to the SME Development Act, renaming it the Micro, Small and Medium Enterprise Transformation and Upgrading Development Act (our translation). The draft expands support for micro businesses and adds a transformation investment tax credit that lists AI applications and digital investments. For Taiwanese SMEs, adopting AI or digital systems may gain one more route of policy support. But the draft still has to go through the Legislative Yuan and has no legal effect until it passes.
1. What happened
According to the Executive Yuan's October 8 press release, the amendment changes the name and structure and adds incentives, strengthening current policy measures and writing them into law. Premier Cho Jung-tai outlined five points: wider eligibility for support, a big-helps-small approach to industry cluster transformation, better tax incentives for hiring and raising pay, a higher R&D investment tax credit plus a new transformation investment tax credit, and a new chapter on nurturing startups.
The part most related to AI is the tax credit. Central News Agency and Economic Daily News reported on October 8 that the new transformation equipment tax credit covers smart machinery, AI applications, and digital and net-zero investments, with a lower threshold than the Statute for Industrial Innovation. A September 10 press release from the Small and Medium Enterprise and Startup Administration also said the digital management systems that service businesses need are included for the first time. According to the reports, the R&D tax credit rate is proposed to rise to 20%.
On who gets support, the Executive Yuan said the draft brings in shopping districts, markets, night markets, agricultural businesses and tourism lodging, helping them with digital transformation and sales. The Ministry of Economic Affairs also plans to add budget over the next 8 years; amounts follow official announcements. The Executive Yuan will send the draft to the Legislative Yuan and asked the ministry to work actively with all caucuses there.

2. What it means for SMEs in Taiwan
Our view: the most notable part of this draft is that AI applications and digital management systems for service businesses are written into the tax credit. Many small shops have felt tax incentives had thresholds too high to matter to them; setting a lower threshold than the Statute for Industrial Innovation suggests the policy wants to reach smaller companies.
But you can't treat it as an incentive you can apply for yet. The Legislative Yuan has to review it, and the text and numbers may change. After it passes, the detailed rules from the authorities will decide which items count and what documents you need. An AI or digital investment should still be judged on whether it saves time and helps you respond to customers, not only on the tax credit.
3. What you can do now
- Pick one daily, repetitive, time-consuming task, such as replying to customer messages, sorting orders or making shift schedules, and note how much staff time it takes today.
- When you adopt AI or automation tools, keep quotes, contracts, invoices and acceptance records; if the act passes, claiming a credit will be easier to prepare.
- Ask your accountant to follow the Legislative Yuan review and the detailed rules that come later, instead of timing investments off news headlines.
- If you are in a shopping district, market or night market, or run tourism lodging, watch for further guidance from the Ministry of Economic Affairs; these groups are now named in the scope of support.
- Beyond policy, whether customers find you on Google and in AI answers still depends on a complete, accurate website and Google Business Profile.
The short version
The draft brings AI and digital investments into a tax credit, which points in a helpful direction for SMEs, but it has to pass the Legislative Yuan and get detailed rules first; for now, get the processes you want to improve and your paperwork ready.

- No. What the Executive Yuan passed on October 8 is a draft. It goes to the Legislative Yuan, takes effect only after it passes and is promulgated, and its content may change.
- Will AI customer service or AI software qualify for a tax credit?
- Not yet certain. Reports say the new transformation tax credit covers AI applications and digital investments, but which items qualify, and the thresholds and caps, depend on the final text and detailed rules; amounts follow official announcements.
- Do very small shops count?
- According to the Executive Yuan, the draft expands support for micro businesses and adds shopping districts, markets, night markets, agricultural businesses and tourism lodging. Actual eligibility depends on the final text.
